These terms and conditions (“Terms”) apply to the XFINITY® Property Perks Program (“Program”). By enrolling in or otherwise participating in the Program as Property Staff (defined below), you agree to these Terms.
Program Overview: The Program rewards eligible property professionals (“Property Staff”) who work at participating properties (“Properties”) for promoting Xfinity services to and referring residents residing at their Property (“Residents”) to sign up for Xfinity Services. Property Staff can earn rewards under the Program (“Rewards”) when residents sign up for Eligible Services in accordance with the terms below. Rewards will be provided in the form of virtual, pre-paid cards ("Pre-Paid Cards").
Program Period: The Program begins October 8th, 2024 and continues until January 5th, 2025. Comcast may, at its sole discretion, extend, shorten or terminate the Program at any time in its sole discretion. The term of the Program, including any extensions thereto, shall be referred to as the “Program Period”.
Participating Properties:
- The Program will be available only at Properties covered by an active access and service agreement containing marketing rights (“Agreement”) between Comcast and the Property owner/manager (“Property Owner”). Property Staff participating in the Program do so in their role as an agent of the Property Owner, subject to all rights, obligations and restriction of the Property Owner. You are at all time required to ensure that you are eligible to participate in the Program and that you maintain compliance with all laws applicable to you and the Program.
Property Staff Eligibility:
- To by eligible for Rewards, Property Staff must (i) be authorized to participate in the Program by their Property owner and receive approval from an authorized Comcast representative; (ii) enroll into the Program by logging into the rewards web site provided via email (as may be revised by Comcast, “Site”), completing all enrollment information, and submitting a request to participate through the Site; (iii) accept and comply at all times with these Terms and any other terms and conditions presented; (iv) agree to receive email communications from Comcast and any third party administering the Site on behalf of Comcast (“Administator”); and (v) be accepted by Comcast to participate in the Program, as confirmed by an e-mail from Comcast. Without limitation, Property Staff must, at all times during the Program Period, be employed at a Property with an active and valid Agreement.
- Property Staff working at Properties with bulk billing arrangements for Xfinity internet and those with non-upgradable services are not eligible to participate in the Program.
- Employees of Comcast Cable Communications Management, LLC, its affiliates, and their respective parents, affiliates and subsidiaries, and the immediate family members of all such employees and all others with whom they are domiciled are not eligible to participate in the Program or receive any Rewards. COMCAST WILL NOT BE RESPONSIBLE FOR ANY ERRORS OR PROBLEMS, WHETHER CAUSED BY EQUIPMENT, PROGRAMMING, HUMAN ERROR OR OTHERWISE, RELATING TO OR IN CONNECTION WITH THE PROGRAM, THE SITE OR THE REWARDS, INCLUDING, WITHOUT LIMITATION, ERRORS IN CONNECTION WITH THE PROCESSING, DESIGNATION OR DISTRIBUTION OF REWARDS.
Eligible Services: "Eligible Services" means Xfinity post-paid Internet and Mobile services for residential customers only. Pre-Paid internet and mobile services, and any other Xfinity services, are not eligible for Rewards under this Program. Property Staff can receive Rewards when they refer Eligible Services to Residents who subscribe to the Eligible Services under the following conditions (an “Activation”):
- The Resident must subscribe to the Eligible Service during the Program Period.
- The Resident must not already subscribe to an Eligible Service or have subscribed to an Eligible Service within the prior 120 days (unless they subscribed when they resided at a different property);
- The Resident must be accepted by Comcast (i.e., meet applicable credit, service and equipment requirements); and
- The Resident must remain subscribed to the Eligible Service in good standing for a period of at least 45 days.
Rewards: Rewards will be distributed after the completion of the Property Period. Property Staff may receive a Pre-Paid Card valued at $25 for each Activation by a Resident of a single Eligible Service or $50 for each Activation by a Resident of two Eligible Services. A subscription to internet or mobile services counts as only one Activation, regardless of the number of add-ons or lines purchased by a Resident. The maximum value of Rewards per Property Staff within any Program Period or within a calendar year is Five Hundred Dollars ($500) in value, regardless of the number of referrals or Activations. Rewards will be distributed and redeemed via an email from Comcast or its third party Site administrator. Separate terms and conditions apply to the use of the Pre-Paid Cards and your receipt of Rewards is subject to your compliance thereof.
Tax Liability: Property Staff shall be solely responsible for any and all taxes related or attributable to the Rewards, if any, and as a condition of eligibility to participate in the Program will agree to indemnify Comcast and its affiliates for any claimed tax liability imposed on Comcast, its affiliates or you in connection with Rewards.
General Provisions:
- Property Staff may be required to share information with the Administrator in order to receive Rewards. Comcast is not responsible for the acts or omissions of the Administrator, including for the tabulation or fulfillment of any Rewards. Any information you provide to the Administrator is subject to the terms and privacy policy of the Administrator. Only the participating Property Staff can claim Rewards. Rewards cannot be sold, resold, returned, exchanged, or substituted. Comcast is not responsible for lost, stolen or damaged Pre-Paid Cards. If Property Staff list a Pre-Paid Card for sale, or sells a Pre-Paid Card, the Pre-Paid Card must be forfeited and will be voided.
- Property Staff shall ensure they have consent, or shall obtain consent, from each Resident (i) to send Resident contact information to Comcast to enable Comcast to confirm Rewards and (ii) to provide Resident with information about signing up for Comcast services.
- Property Staff may not promote the Program through paid media, such as billboards, banner advertisements, or sponsored search results. Property Staff may not enter an arrangement with any third party that compensates that third party for promoting the Program or referrals. Nothing herein or otherwise part of the Program prevents Property Staff from also promoting products or services of other third parties as long as property staff are in compliance with agreements between Comcast and the Property owner.
- Comcast’s decisions will be final and binding in all matters related to the Program. Properties and Property Staff cannot participate in any other Comcast or Xfinity- sponsored reward programs while participating in the Program.
Disqualification: Comcast reserves the right to disqualify any person or Property Staff and void the corresponding Rewards of any person or Property Staff at its sole discretion, including anyone who is in violation of these Terms.
Changes, Termination and/or Removal From Program: Comcast reserves the right, in its sole discretion, to change the Program, Rewards and eligibility criteria under the Program, remove a Property or Property Staff from participating in the Program, and/or to alter, modify, limit, suspend or terminate the Program at any time with or without notice. It is the responsibility of Property Staff to check and review the Terms from time to time to keep informed of any changes. By joining the Program, Property Staff agree to be bound by all such changed Terms.
Limitation of Liability; Releases: ALL REWARDS ARE PROVIDED “AS IS” WITH NO GUARANTEES. ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE HEREBY DISCLAIMED BY COMCAST. Participating Property Staff are employed exclusively by the Property owners and not by Releasees (defined below), jointly or otherwise, and acknowledge that they have participated in the Program voluntarily and have no right to wages or benefits of any kind from Releasees. Neither Comcast nor any Rewards partner shall have any responsibility or liability whatsoever for any property loss, damage, or personal injury in connection with any pre-paid card provided as part of the Program and/or any Property Staff’s participation in the Program. When Property or Property Staff claims and/or uses a pre-paid card or otherwise participates in the Program, the Property and Property Staff releases Comcast and its past and present parents, affiliates and subsidiaries and all pre-paid card partners, and each of their officers, employees, benefit plans, benefit plan administrators, and agents (“Releases”) from all claims, actions, causes of actions and damages, including without limitation, claims of personal injury, property damage, and infringement of rights of publicity, arising out of the use of pre-paid cards, or in connection with participation in pre-paid card events or the Program, as well as from all claims, actions, causes or action or damages arising from any claimed employment, joint employment, or co-employment relationship with Releasees. This limitation and waiver will apply regardless of the theory of liability. This limitation of liability also applies if a Property Staff brings a claim against any pre-paid card partner, to the extent Comcast would be required to indemnify such company against any claims. Property Staff agrees that Comcast is not responsible for problems caused by any pre-paid card partner, Property, or by any Force Majeure Event.
